Andrew White*

Andrew leads cross-border commercial transactions, international arbitrations, and US-litigation, involving business and investment interests.  Throughout his career, Andrew has lived and worked in North Asia and Southeast Asia, the UK and Europe, the Middle East, Australia, and North America.  Prior to joining Rousseau Mazzuca, Andrew was a partner in several international law firms based in Europe, Asia, the Middle East, and North America.  During that time, he also was a university law professor (including international commercial arbitration/ mediation courses), as well as Founding Director of the International Islamic Law & Finance Centre in Singapore Management University.

Andrew has significant international experience as an arbitrator and advocate in arbitrations under diverse arbitration Tribunals and Centers, including primarily the International Chamber of Commerce Court of Arbitration (ICC-Paris and Hong Kong); the Singapore International Arbitration Centre (SIAC); the Dubai International Arbitration Centre (DIAC); the Asian International Arbitration Centre (AIAC); and the American Arbitration Association (AAA).  He is a Fellow of the Singapore Institute of Arbitrators; was a consultant to the Asian International Arbitration Centre for development of its Islamic Arbitration Rules; and he was formerly an Adjudicator in Singapore’s Financial Industry Disputes Resolution Centre (FIDReC).  Andrew was previously appointed to the International Chamber of Commerce (ICC-Paris) Task Force on Financial Institutions and International Arbitration.  He also was trained and certified as a court-appointed mediator more than 30 years ago.

Andrew has authored textbooks by Oxford University Press, Wiley & Sons (Wiley Finance Series), and McGraw-Hill.  He was previously the Managing Editor, Asia Pacific Mediation Journal.  He was a co-author of the leading North American treatise and digest of construction and design law.  His experience and expertise as an arbitrator (frequently presiding chairman) and as an advocate includes:

  • scheduling claims: acceleration/prolongation/delay

  • scope of work change orders/increased material and labor costs

  • design defects

  • differing/unforeseen site conditions, esp. geology, soil, hydrology

REPRESENTATIVE WORK:

  • Acting for the prime contractor in construction of a multi-billion dollar (USD) shipyard and associated marine facilities.

  • Acting for the investor/owners constructing a high-capacity steel casting foundry.

  • Acting for a French aerospace company in structuring and operating its related companies in North America.

  • Acting for a Korean Government-owned enterprise in negotiating oil & gas rights under a production sharing agreement with an Indonesian State Enterprise.

  • Acting for parties in cross-border arbitrations in Singapore (SIAC) and Dubai (DIAC).

  • Defending a Korean energy provider in cross-border arbitration regarding wrongful cancellation of a supply contract for Russian steam coal to be burned in Circulating Fluidized Bed Combustion (CFBC) boilers.

  • Defending a Korean construction company in cross-border arbitration and mediation involving the construction of highly sensitive security and military intelligence facilities on a US military base.

  • Advising a Middle Eastern military technology company regarding a joint venture and the exporting and importing of intellectual property rights.

  • Structuring and negotiation of extensive aerospace, energy, and other sales and distribution agreements for technology companies in North America, Europe and Asia.

  • Defending a Korean financial institution in US federal court litigation and a related appeal concerning a securities sale.

  • Managing defense with US criminal counsel in investigation of Korean conglomerate by US Department of Justice.

  • Pursuing US federal court litigation on behalf of a Korean financial institution against US entities.

  • Advising Middle Eastern sovereign wealth funds and related investors regarding US commercial real estate assets.

  • Advising a large Southeast Asian insurance and takaful company on Shariah compliance and conducted a contract certainty audit of its facultative reinsurance/retakaful arrangements.

  • Advising an Australian global fund manager on creating a Shariah-based musharakah joint venture with a large Middle Eastern Islamic financial institution.

  • Advising owners and conducted a framework review on Islamic murabahah funding for development/construction of high-profile office development in Central London (UK)
